Child-Resistant Packaging — 1 Oct 2026 — estvape EU B2B vape wholesale guide

Embalagem à prova de criança desde 1-10-2026

18+ only · Compliance briefing for EU vape wholesalers, distributors and retailers.

From 1 October 2026, disposable vapes and e-liquid refill containers supplied in the EU must use third-party-verified child-resistant packaging. Self-declaration is not sufficient. For anyone buying wholesale stock, this is a purchasing-desk issue rather than a design issue: the question is not “does my packaging look child-resistant”, but “can my supplier produce the test certificate for this batch”. This briefing covers what changes, what evidence is required, and how to protect your stock position.

What actually changes

Child-resistant packaging requirements for vaping products have been tightening across the EU, and from 1 October 2026 the requirement is expected to apply to all new shipments of disposable devices and refill containers. Three points define the change:

  • Verification is external. The packaging must be tested to a recognised child-resistance protocol by an accredited third-party laboratory. A manufacturer’s own statement of compliance does not satisfy the requirement.
  • It applies per product and pack format. A certificate for one device in one pack format does not automatically cover the same device in a different pack, or a different device in the same pack.
  • It is a condition of supply, not a marketing feature. Stock without the certificate becomes unsaleable inside the EU from the effective date.

The test protocol, in plain terms

Child-resistance is assessed by panel testing: a group of young children are given the packaging and a fixed time window to try to open it, and a group of adults are asked to open and re-close it. Packaging passes only if children fail to open it within the window at the required rate and adults can open it without unreasonable difficulty. Protocols of this shape have been used for medicines and household chemicals for decades; the newer work extends that discipline to vaping products.

Two practical consequences follow. First, a packaging change can fail the adult-access part even when it passes child-resistance — over-securing is a real failure mode. Second, re-testing is required when the pack design changes materially.

What a compliant supplier should be able to give you

Ask for all four of the following, per SKU:

  1. The child-resistant packaging test certificate from an accredited third-party laboratory, naming the pack format tested.
  2. The packaging specification the certificate refers to, so you can confirm the artwork and the tested format match.
  3. The EU-CEG notification for the same SKU, since packaging is described within the notification.
  4. A statement of which production batches or date codes the certificate covers.

If a supplier can only show a logo or a claim on a spec sheet, treat the SKU as non-compliant stock for EU supply after the deadline.

Who carries the risk

The obligation sits with the party placing the product on the EU market — the manufacturer if established in the EU, otherwise the importer. In practice that means:

  • If you import directly, you are the importer, so the evidence obligation lands on you. You need the certificate in your files, not just a promise in an email.
  • If you buy from an EU warehouse distributor, the distributor is responsible for supplying compliant packaging on stock already in the EU. You should still hold the certificate on file, but you are not the party commissioning the test.

This is one of the quieter arguments for EU-warehouse sourcing: it moves a per-SKU testing and documentation burden off your desk.

What to do in the run-up to 1 October 2026

  1. Inventory your SKUs and mark which ones have a certificate on file and which do not. Do this now, not in September.
  2. Request certificates in writing per SKU, and store them alongside the EU-CEG ID and the lab report.
  3. Do not over-order non-certified stock in the weeks before the deadline — you may be holding product you cannot legally supply.
  4. Check your own retail packaging if you repack or bundle. A bundle you create is a pack format you are responsible for.
  5. Confirm your supplier’s reorder position. If certificates are pending, you want to know before you commit volume, not after.
  6. Refresh at the next batch change. The certificate covers the pack format tested; a redesign restarts the process.

Common misconceptions

  • “Our packaging is hard to open, so it’s compliant.” — It must pass a defined protocol with both child and adult panels, tested by a third party.
  • “The factory says it complies.” — A declaration is not a test certificate.
  • “The certificate covers the brand.” — It covers the specific pack format that was tested.
  • “We can sell through the old stock after October.” — Placing non-compliant stock on the market after the effective date is the issue, not the date it was manufactured. Confirm your position with your adviser.

Where we stand

We source only from manufacturers holding third-party child-resistance certification for the applicable pack format, and we archive the certificate per SKU so it can be supplied to buyers on request alongside the EU-CEG documentation. The full document list is set out in our compliance centre, and the surrounding regulatory picture is covered in the TPD field guide for distributors.

Informational only, not legal advice. Effective dates and scope are set at EU level and implemented nationally; confirm the current position for each market you supply with a qualified adviser before committing stock.
