The TPD 2 ml Tank Limit Explained — estvape EU B2B vape wholesale guide

Limit TPD 2 ml: dlaczego vape są ograniczone

18+ only · Regulatory explainer for EU vape wholesalers and retailers.

The 2 ml limit is one of the two hard numbers in EU vaping regulation, sitting alongside the 20 mg/ml nicotine cap. It restricts the volume of the reservoir in a disposable device or pod, and it explains a great deal about why EU disposables look and behave differently from the same brand’s products in other regions. Here is exactly what the rule covers, where the boundary lines are drawn, and what it means commercially for buyers.

What the 2 ml rule covers

Under Directive 2014/40/EU, a disposable device or a cartridge/pod must not hold more than 2 ml of nicotine-containing liquid in its reservoir. The separate limit for refill containers used with open-system devices is 10 ml. The two limits are frequently conflated; they govern different product categories.

Product type Volume limit
Disposable device (sealed unit) 2 ml reservoir
Prefilled pod / cartridge 2 ml
Refill container for open system 10 ml

The 2 ml cap applies to the liquid the reservoir can hold — not to what the user can consume before the battery dies, and not to total nicotine content in the pack.

Why the cap exists, and what it changed

The limit was designed to keep single-container liquid volume small, on the reasoning that a smaller reservoir reduces the consequences of accidental ingestion and makes the product less attractive for bulk decanting. Whatever view one takes of that reasoning, the commercial effects have been substantial and are visible across the entire EU market:

  • The puff-count race replaced the capacity race. Because you cannot compete on liquid volume, manufacturers compete on coil efficiency, battery capacity and puff claims.
  • Total nicotine per device is capped. At 2 ml and a maximum 20 mg/ml, a compliant disposable holds at most 40 mg of nicotine regardless of its puff claim. This is why EU-market devices are typically labelled 2% rather than 5%.
  • Format innovation moved to hardware. Dual-flavour switching, screens, mesh coils, adjustable airflow — all of it fills the competitive space that capacity would otherwise occupy.

Where the boundary questions sit

Four questions come up repeatedly in practice, and they are worth understanding before you buy:

  1. Is the limit on the reservoir or on total liquid in the pack? It is the reservoir inside the device. A carton containing multiple compliant devices is not itself a 2 ml question.
  2. What about a device with two reservoirs? Dual-tank products raise an interpretive question about whether each reservoir or the combined volume is measured. Manufacturers take different positions; the conservative reading is the combined volume. Treat dual-tank capacity claims with care and verify the position with your adviser.
  3. Does the 2 ml limit apply to nicotine-free products? It is framed around nicotine-containing liquid. Several member states regulate nicotine-free vaping products separately, so do not assume exemption; check the market.
  4. Can a device be sold with a larger tank as a kit? Selling a larger capacity device into the EU consumer market is not enabled by labelling it as a spare or a kit. The product as placed on the market governs.

What it means at the purchasing desk

Because capacity is fixed, the honest differentiators in a wholesale catalogue are these:

  • Confirmed reservoir volume at or below 2 ml, stated in ml on the current documentation.
  • A valid EU-CEG notification for that exact configuration, including the reservoir.
  • Coil consistency over the claimed puff count, which is where cheap stock and premium stock genuinely diverge in customer satisfaction.
  • Battery and charging design, since a large claimed puff count on a small cell produces exactly the flat-taste complaints that drive returns.

If a supplier cannot confirm reservoir volume in millilitres on request, that is a documentation gap you should not accept on EU-bound stock.

The export dimension

Products with reservoirs above 2 ml circulate legitimately in markets outside the EU. If you serve both EU and non-EU customers, those SKUs need to be either physically segregated or controlled by documented picking rules — a single mis-picked carton into an EU destination is a compliance event, not an inventory error. This is one reason many buyers simply keep the two ranges in separate catalogues.

How we handle it

Every SKU we ship inside the EU has a confirmed reservoir at or below 2 ml with a matching EU-CEG notification, and a documented child-resistant pack format for shipments from 1 October 2026. Larger-capacity SKUs are reserved for verified non-EU and re-export buyers. The wider framework is covered in the TPD compliance field guide and the 20 mg/ml explainer.

Informational only, not legal advice. Interpretations of the 2 ml limit vary on edge cases such as multi-reservoir designs. Confirm your specific product’s position with a qualified regulatory adviser.
