Private label \u2014 OEM manufacturing \u2014 is the standard route, and in the EU it comes with a specific set of obligations that most first-time buyers underestimate. This guide covers what private label actually involves, realistic minimums, the paperwork you inherit, and where margin really comes from.<\/p>\n<h2>What &#8220;private label&#8221; means in practice<\/h2>\n<p>There are three distinct arrangements sold under the same label, and they are not equivalent:<\/p>\n<ul>\n<li><strong>White label<\/strong> \u2014 you buy an existing device and an existing flavour, and the factory prints your logo on the retail box. Nothing in the product changes. Fastest and cheapest.<\/li>\n<li><strong>Private label<\/strong> \u2014 existing hardware, but your own flavour formula and your own packaging design. You own the flavour; the device is shared with other buyers.<\/li>\n<li><strong>OEM \/ full custom<\/strong> \u2014 custom housing, custom coil\/pod, custom firmware, custom flavour. You are commissioning a device, not rebranding one.<\/li>\n<\/ul>\n<p>Most EU buyers who ask for &#8220;private label&#8221; actually want option one or two. Your total commitment is MOQ \u00d7 number of SKUs \u00d7 number of flavours. A three-flavour private-label launch is therefore a five-figure order before you have sold a single unit.<\/p>\n<h2>The paperwork problem \u2014 who owns the EU-CEG notification<\/h2>\n<p>This is the part that catches buyers out. Under TPD, the <strong>product placed on the EU market<\/strong> must be notified in EU-CEG. If you are the brand on the box, you are the one on the hook for that notification \u2014 not the Chinese factory, and not the distributor.<\/p>\n<p>In practice there are two clean structures:<\/p>\n<ol>\n<li><strong>You hold your own EU-CEG notification.<\/strong> You notify the SKU, you own the ingredient and emissions data, and you can move supplier later without losing the registration. More work upfront, far more durable.<\/li>\n<li><strong>Your EU distributor holds it on your behalf.<\/strong> Common when you buy through a distributor rather than direct. Faster to market, but the notification is tied to them \u2014 change distributor and you restart.<\/li>\n<\/ol>\n<p>What you should never accept is a factory saying &#8220;we already have the notification, use ours&#8221;. If the notification is in a third party&#8217;s name, you are not the brand owner for regulatory purposes, and a customs hold will expose that.<\/p>\n<h2>Documents you must hold per SKU<\/h2>\n<p>Before a private-label SKU can be legally sold in the EU you need, for each SKU:<\/p>\n<ol>\n<li>EU-CEG notification ID in the correct legal entity&#8217;s name<\/li>\n<li>Ingredient declaration and full flavour formula documentation<\/li>\n<li>CLP-compliant safety data sheet (SDS) for the nicotine solution<\/li>\n<li>ISO 17025 accredited emissions \/ heavy-metals lab report<\/li>\n<li>Child-resistant packaging certificate \u2014 mandatory for shipments from 1 October 2026<\/li>\n<li>Battery transport documentation (UN 38.3 test summary) for the device cell<\/li>\n<\/ol>\n<p>Build the cost of items 1, 4 and 5 into your unit economics at the quoting stage \u2014 together they typically add low single-digit cents per unit at volume, but several hundred euros per SKU in fixed cost.<\/p>\n<h2>Where the margin actually comes from<\/h2>\n<p>Buyers usually justify private label with &#8220;better margin&#8221;. That is only half true. Factory cost per unit for a private-label device is often <em>higher<\/em> than for the equivalent white-label device, because your volume is lower. The margin improvement comes from three other places:<\/p>\n<ul>\n<li><strong>Price positioning.<\/strong> A branded-looking exclusive line supports a higher retail price than a commodity SKU in a crowded category.<\/li>\n<li><strong>No price comparison.<\/strong> A competitor cannot undercut you on a SKU they cannot buy.
