Packaging passes only if children fail to open it within the window at the required rate <em>and<\/em> adults can open it without unreasonable difficulty. First, a packaging change can fail the adult-access part even when it passes child-resistance \u2014 over-securing is a real failure mode. Second, re-testing is required when the pack design changes materially.<\/p>\n<h2>What a compliant supplier should be able to give you<\/h2>\n<p>Ask for all four of the following, per SKU:<\/p>\n<ol>\n<li>The <strong>child-resistant packaging test certificate<\/strong> from an accredited third-party laboratory, naming the pack format tested.<\/li>\n<li>The <strong>packaging specification<\/strong> the certificate refers to, so you can confirm the artwork and the tested format match.<\/li>\n<li>The <strong>EU-CEG notification<\/strong> for the same SKU, since packaging is described within the notification.<\/li>\n<li>A statement of which <strong>production batches or date codes<\/strong> the certificate covers.<\/li>\n<\/ol>\n<p>If a supplier can only show a logo or a claim on a spec sheet, treat the SKU as non-compliant stock for EU supply after the deadline.<\/p>\n<h2>Who carries the risk<\/h2>\n<p>The obligation sits with the party placing the product on the EU market \u2014 the manufacturer if established in the EU, otherwise the importer. In practice that means:<\/p>\n<ul>\n<li>If you <strong>import directly<\/strong>, you are the importer, so the evidence obligation lands on you. You need the certificate in your files, not just a promise in an email.<\/li>\n<li>If you <strong>buy from an EU warehouse distributor<\/strong>, the distributor is responsible for supplying compliant packaging on stock already in the EU. You should still hold the certificate on file, but you are not the party commissioning the test.<\/li>\n<\/ul>\n<p>This is one of the quieter arguments for EU-warehouse sourcing: it moves a per-SKU testing and documentation burden off your desk.<\/p>\n<h2>What to do in the run-up to 1 October 2026<\/h2>\n<ol>\n<li><strong>Inventory your SKUs<\/strong> and mark which ones have a certificate on file and which do not. Do this now, not in September.<\/li>\n<li><strong>Request certificates in writing<\/strong> per SKU, and store them alongside the EU-CEG ID and the lab report.<\/li>\n<li><strong>Do not over-order non-certified stock<\/strong> in the weeks before the deadline \u2014 you may be holding product you cannot legally supply.<\/li>\n<li><strong>Check your own retail packaging<\/strong> if you repack or bundle.
